Aquest reglament,   <\/span><strong><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2008-2486\">publicat al BOE<\/a><\/strong> <span style=\"font-weight: 400;\">el febrer de 2008, estableix les condicions legals per a la gesti\u00f3 dels residus de construcci\u00f3 i demolici\u00f3 (RCDs) a Espanya, amb l&#8217;objectiu de fomentar la reutilitzaci\u00f3, reciclatge i valoritzaci\u00f3 davant l&#8217;abocament.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A continuaci\u00f3, t&#8217;expliquem de manera clara en qu\u00e8 consisteix, a qui afecta i com complir-ho correctament per evitar sancions i contribuir a una obra m\u00e9s sostenible.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Que_regula_el_RD_1052008\"><\/span><b>Qu\u00e8 regula el RD 105\/2008?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">El RD 105\/2008 t\u00e9 com a objectiu principal reduir limpacte ambiental dels residus generats durant obres i demolicions. Per aix\u00f2, estableix mesures concretes a totes les fases d&#8217;un projecte: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prevenci\u00f3 i separaci\u00f3 a l&#8217;origen dels residus.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Obligaci\u00f3 de redactar un Pla de gesti\u00f3 de RCDs.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Requisits de valoritzaci\u00f3 i reciclatge dels materials.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Obligacions documentals i tra\u00e7abilitat.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Condicions per al lliurament i la recepci\u00f3 de residus.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Aquest decret s&#8217;emmarca dins l&#8217;<\/span> <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2022-5809\"><span style=\"font-weight: 400;\">estrat\u00e8gia nacional de gesti\u00f3 de residus<\/span><\/a> <span style=\"font-weight: 400;\">i tamb\u00e9 respon a directrius europees per al foment de l&#8217;economia circular.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"A_qui_aplica_el_RD_1052008\"><\/span><b>A qui aplica el RD 105\/2008?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">El decret afecta tots els agents que intervenen en obres de construcci\u00f3 o demolici\u00f3, tant p\u00fabliques com privades.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Promotors: responsables d&#8217;incloure el pla de gesti\u00f3 de residus al projecte i assumir-ne el cost.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Projectistes: han d&#8217;incorporar el pla a la documentaci\u00f3 t\u00e8cnica.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contractistes: executen l&#8217;obra d&#8217;acord amb el pla aprovat i han de garantir la gesti\u00f3 correcta dels residus.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gestors autoritzats: com nosaltres, Corporaci\u00f3 Everest, responsables del tractament, valoritzaci\u00f3 o eliminaci\u00f3 final.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Obligacions_clau_del_RD_1052008\"><\/span><b>Obligacions clau del RD 105\/2008<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Aquestes s\u00f3n les principals exig\u00e8ncies que han de complir les empreses a l&#8217;obra:<\/span><\/p>\n<h4><span class=\"ez-toc-section\" id=\"1_Pla_de_Gestio_de_RCDs\"><\/span><b>1. Pla de Gesti\u00f3 de RCDs<\/b><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p><span style=\"font-weight: 400;\">Abans de l&#8217;inici de l&#8217;obra, cal presentar un pla detallat que inclogui:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Estimaci\u00f3 de la quantitat i tipus de residus.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Operacions previstes per a la separaci\u00f3 i gesti\u00f3.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Destinaci\u00f3 prevista: valoritzaci\u00f3, reciclatge o eliminaci\u00f3.<\/span><\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"2_Fianca_economica\"><\/span><b>2. Fian\u00e7a econ\u00f2mica<\/b><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p><span style=\"font-weight: 400;\">El promotor ha de constituir una fian\u00e7a que garanteixi la gesti\u00f3 correcta dels residus. Aquesta es recupera en justificar documentalment la destinaci\u00f3 final dels RCDs. <\/span><\/p>\n<h4><span class=\"ez-toc-section\" id=\"3_Lliurament_a_gestors_autoritzats\"><\/span><b>3. Lliurament a gestors autoritzats<\/b><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p><span style=\"font-weight: 400;\">Tots els residus han de ser lliurats a gestors autoritzats per ladministraci\u00f3, els quals han demetre els documents de seguiment i control corresponents.<\/span><\/p>\n<h4><span class=\"ez-toc-section\" id=\"4_Tracabilitat_i_documentacio\"><\/span><b>4.
